1. Agreement
These Terms & Conditions form an agreement between you ("Client") and Smile Pic Photography ("Provider"). By booking our services you agree to these terms.
2. Booking & Payment
Bookings are confirmed on receipt of a signed agreement (if provided) and required deposit. Full payment terms vary by package; final balance is due before or on the event date unless agreed otherwise in writing.
3. Prices & Changes
Prices displayed are in INR and exclude local taxes unless stated. We reserve the right to change prices for future bookings; confirmed bookings are billed at the agreed price.
4. Deliverables & Turnaround
Delivery timelines are described within your package. We provide edited photos and videos according to the package details. Minor edits or color grading requests are included; extensive re-edits may incur additional fees.
5. Intellectual Property & Copyright
We retain copyright of all images and videos we create. On delivery you receive a license to use the media for personal, non-commercial purposes, unless a separate commercial license has been purchased. You may share produced images but may not resell, re-license, edit heavily, or claim authorship.
You may not remove watermarks, logos, or copyright notices from any media we provide. You may not use our photos, videos, text, designs, or layouts as templates for other photographers or businesses without our written permission.
You may not scrape, download, or attempt to systematically copy content from our Website using automated tools including bots, crawlers, or AI systems. You may not use our content to train artificial intelligence (AI) models, machine learning systems, datasets, or any similar technology without an explicit written license from us.
6. Website Protection & Security
This Website may include technical measures such as watermarking, disabled right-click, blocked downloads, or code obfuscation in order to protect our intellectual property. Attempting to bypass, disable, or remove these protections, or assisting others to do so, is strictly prohibited and may constitute a violation of applicable copyright laws.
7. Usage for Promotion
We may use non-sensitive, non-identifying images or short clips from your event for our portfolio, social media, or marketing materials unless you provide a written objection prior to the event. If you request full privacy, this may affect pricing and must be agreed in advance.
8. Cancellation & Refunds
If you cancel, deposits may be non-refundable. For cancellations by the Provider due to illness, emergencies, or force majeure, you will receive a full refund or an option to reschedule, subject to availability. For more details see our Refund Policy (if available).
9. Liability
Our liability for any claim arising from the services is limited to the amount paid by the Client for the booking. We are not responsible for indirect or consequential losses, travel delays, venue issues, or events beyond our reasonable control (including weather, equipment failure despite regular maintenance, or power outages).
10. Subcontracting
We may use qualified partners such as assistants, second shooters, or external labs. We remain responsible for the final quality of the delivered work and overall client experience.
11. Client Obligations
Clients must provide accurate event information, obtain necessary permissions for locations (including venue approvals and photography permits), and cooperate reasonably to allow us to perform our services.
12. Complaints
Any concerns regarding delivered work should be raised within 14 days of delivery. We aim to resolve issues quickly and fairly.
13. Governing Law
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or our services will be subject to the exclusive jurisdiction of the competent courts located in Tamil Nadu, India.
